CALIFORNIA LOW NOx UPDATE

To Our California Customers,

Any weatherized furnace (Packaged Units) manufactured on or after the compliance date listed in Table 1 may only be sold or installed in the South Coast Air Quality Management District (SCAQMD) and the San Joaquin Valley Air Pollution Control District (SJVAPCD) if they comply with the new 14 ng/J NOx emission limit. Due to the time and investment to develop and commercialize a compliant packaged unit, Lennox will offer two options; prebuild units and non-compliant units subject to a surcharge.

Prebuild Packaged Units
Prebuild weatherized furnaces (Packaged Units) are manufactured prior to the compliance date and may be installed through the end of the sell-through period as listed in Table 1 in lieu of meeting the new emission limit. Prebuild weatherized furnaces (Packaged Units) are identified with new CAT numbers for tracking purposes and are as listed in the attached.

Non-Compliant Packaged Units
Any weatherized furnace manufactured (Packaged Units) on or after the above date of October 1st, 2016, which does not meet the new 14 ng/J NOx emission limit will be deemed non-compliant and may only be sold or installed into these districts if assessed a per unit surcharge as listed in Table 2. Manufacturers are required to report all non-compliant units distributed and sold into the SCAQMD and SJVAPCD and pay the surcharge. To comply with these new regulations, Lennox will automatically invoice a mitigation/emission surcharge for orders of non-compliant (standard CAT#), non-prebuild units shipped into the SCAQMD or SJVAPCD areas.

Prebuild packaged units were manufactured prior to the October 1, 2016 compliance date and may be installed into the South Coast Air Quality District and San Joaquin Valley Air Pollution Control District for a period of 300 days starting the date of compliance in lieu of meeting the 14 ng/J NOx emission limit. These units will not be assessed a mitigation/emission surcharge through the time of the sell-through period.
